EPA – How to sell pesticide legally

Richard Nixon founded the EPA in 1970.  It is relevant to this blog because Okra Garden Supply’s first product is Diatomite.  Which I am in the process of rebranding to Diatoms.  The name is of little import.  What matters is whether I am going to sell it as a pesticide.  Of seemingly less importance is whether it kills ants.  I am trying to settle both issues.  This post is the beginning of understanding the rules of selling pesticide.  Future posts will address the efficacy of the product.

Selling as Pesticide:

Since I use Diatoms to control ants I need to follow the following rules form the Code of Federal Regulations, which is different that the U.S. Code:

Title 40 – Protection of Environment
Title 40 – Protection of Environment
Chapter I – ENVIRONMENTAL PROTECTION AGENCY (CONTINUED)
Subchapter E – PESTICIDE PROGRAMS
Part 152 – PESTICIDE REGISTRATION AND CLASSIFICATION PROCEDURES
Subpart G – Obligations and Rights of Registrants
Section 152.130 – Distribution under approved labeling

 

Title 40 Protection of Environment: sounds good, I like the environment.

Chapter 1 Environmental Protection Agency:  please note that there is no chapter 2 or three of this title.  The subchapters of chapter 1 are listed alphabetically, and there is no ‘K’, ‘L’, or ‘M’.  Subchapter ‘P’ is ‘reserved’ as are ‘S’ and ‘T’.  I don’t know what reserved means.

Subchapter E “Pesticide Programs” is what I need, I think.  There are 27 parts of that subchapter, and they are numbered Parts 150-180.  The PDF of this is 704 pages long.  Well, if I read at least two pages per day eventually I will know this document.  So, perhaps it will be a little add on to my daily blog.

Oh My.  I just want to sell you Diatoms so that you can garden in peace with piece of mind.

But I guess instead this blog will spend many days moving through Title 40, Chapter 1, Subchapter E.
